These terms govern your use of this website and any consultation or advisory engagement you enter into with The Hayes Partners. By using the site or engaging us, you accept these terms.
1. Who we are
The Hayes Partners is a Miami-based real estate advisory practice operated by James Hayes and Daniel Hayes. References to "we", "us", or "our" mean The Hayes Partners.
2. Scope of services
We provide real estate advisory and acquisition support in respect of Miami and wider USA residential and investment properties. Our services may include market filtering, project evaluation, investor-fit assessment, risk review, developer coordination, and execution support through to handover.
We do not provide regulated financial, investment, tax, legal, or banking advice. Where any of these are needed, we will direct you to qualified professionals. References to "wealth", "advisors", or "investment" on this site relate strictly to real estate and not to securities, funds, or other regulated financial products.
3. Information on this site
Property listings, prices, sizes, layouts, payment plans, and any forecasts shown on this site are indicative and provided in good faith based on information available to us at the time of publication. They are subject to change by developers, regulators, and market conditions and should be independently verified before any decision is made. Renderings are artistic impressions and are not contractual.
Examples of past results are not a guarantee of future performance. Real estate values can rise or fall and capital may be at risk.
4. Engagement and fees
An advisory engagement begins only when both parties confirm scope and any applicable fees in writing. Until then, no fee is owed and no advisory relationship exists. Where we receive commissions or referral fees from developers or counterparties, we will disclose this on request.
5. Reservations and contracts
Property reservations and sale and purchase agreements are between you and the relevant developer, vendor, or brokerage. We may assist in coordinating documentation but we are not a party to those contracts and do not act as escrow agent.
6. KYC and compliance
You agree to provide accurate information including any identification, source-of-funds, or source-of-wealth documentation reasonably requested by us, developers, escrow agents, banks, or regulators. We may decline or terminate an engagement that we cannot complete in compliance with applicable law.
7. Acceptable use of this website
You agree not to (a) attempt to disrupt or compromise the site's security, (b) use automated tools to scrape content, (c) infringe any intellectual property rights, or (d) use the site for any unlawful purpose.
8. Intellectual property
All text, design, code, logos, photography, and renderings on this site are owned by or licensed to The Hayes Partners and are protected by applicable intellectual property law. You may view and share content for personal, non-commercial use, but you may not reproduce, modify, or redistribute it without our written permission.
9. Third-party links and services
This site links to third-party services including WhatsApp, Google, Instagram, Facebook, and YouTube. We are not responsible for the content, terms, or privacy practices of those services. Your use of them is governed by their own terms.
10. Limitation of liability
To the fullest extent permitted by law, The Hayes Partners, its principals, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive losses arising out of your use of this site or our services, including loss of profit, capital, or opportunity. Our total aggregate liability for any direct loss is limited to the fees actually paid by you to us in the twelve months preceding the event giving rise to the claim.
11. Indemnity
You agree to indemnify and hold us harmless from claims arising out of (a) your breach of these terms, (b) your misuse of the site, or (c) inaccurate information provided by you that we reasonably relied upon.

13. Governing law and disputes
These terms are governed by the laws of the State of Florida and applicable U.S. federal law. The courts of Miami-Dade County, Florida have exclusive jurisdiction over any dispute, save where mandatory consumer-protection law in your country of residence provides otherwise.

We may update these terms from time to time. Material changes will be highlighted on this page and the "Last updated" date will be revised.
